An Honorable Discharge is the highest level of discharge available to a military member. It honors a military person who has distinguished himself or herself. Those who obtain an Honorable Discharge will be entitled to all of the privileges and benefits that veterans are entitled to.

Employers will see a person with a General, Under Honorable Conditions discharge as having potential disciplinary and behavioral issues. As a result, most businesses would see someone with a General discharge negatively. Furthermore, if you were discharged with a General discharge, you would lose several benefits, including the GI Bill. If you were discharged with a General discharge, you have the right to have your discharge reviewed by your service’s Discharge Review Board (DRB). You should seriously consider hiring a discharge upgrade lawyer to boost your chances of receiving an Honorable Discharge.

Potential employers will see a person dismissed with an Other Than Honorable (OTH) as having significant difficulties with discipline and conduct. As a result, most, if not all, companies would avoid employing these persons, making it impossible to obtain meaningful employment. Furthermore, those discharged with an OTH will forfeit considerable benefits. If you have been dismissed with this form of discharge, you may believe that the government has taken advantage of you or tricked you. You may, however, seek review from your service’s Discharge Review Board (DRB). You should seriously consider hiring a discharge upgrade lawyer to improve your chances of receiving an upgrade. A discharge upgrade lawyer may be able to upgrade you from an OTH to an Honorable in some instances. In other circumstances, you may only be able to receive an OTH to General upgrade. Brett O’Brien, a discharge upgrade lawyer, will argue for the highest feasible discharge level. Each instance will be different. Even if you can only be upgraded to a General (rather than an Honorable), it is crucial to remember that there are several perks that you may gain with a General that you cannot otherwise achieve with an OTH.

Punitive discharges include those for bad behavior, dishonorable discharges, and dismissal discharges. Employers will stigmatize and view these individuals negatively. The DRB can enhance bad-conduct discharges after a special court-martial conviction. However, discharges resulting from a general court-martial conviction are not eligible for an upgrade by the DRB. You must apply to the Board for Correction of Military Records if you obtained a general court-martial discharge or if you wish to convert your discharge to or from medical retirement or medical discharge.

When the service member has fewer than six months of service, this sort of discharge is utilized. While this discharge is not legally an adverse finding, it might result in stigma since the service member may be perceived as lacking the capacity and/or willingness to complete basic training. Although it is difficult to upgrade these discharges, it is possible.

WHY UPGRADE MY DISCHARGE?

There are several reasons why you might want to revise a discharge. Some of these reasons are listed below:

  • Improved career or job opportunities;
  • Increased educational advantages;
  • To alleviate problems throughout the security clearance application procedure;
  • To rebuild your reputation;
  • To find work at the federal or state level;
  • To be eligible for Veteran’s Affairs benefits; and/or
  • To be compensated for service-related illnesses and injuries.

Your negative discharge ranking might have an unfavorable impact on all of the above-mentioned factors. As a result, it is critical that you aim to receive the greatest discharge possible in order to guarantee that you set yourself up for future success in terms of your job and capacity to obtain benefits.

Your service record, or Certificate of Release or Discharge from Active Duty (DD-214 or NGB-22 if in the National Guard), should show the highest degree of honorable discharge attainable. Those who leave the military with anything other than an Honorable Discharge generally face fewer career opportunities and decreased or canceled benefits.

Many veterans seeking upgrades have gone on to live outstanding lives following their discharge and are frustrated that they are being discriminated against because of a single event that occurred when they were young. Employers may be cautious to recruit such persons if the underlying discharge was due to a criminal infraction, such as drugs or theft, or for any other reason. Even if such occurrences occurred years ago, discharged soldiers are at a disadvantage in today’s competitive job market.

Simply said, those who can secure an upgrade are more likely to earn better positions. Furthermore, they are eligible for benefits such as the GI Bill, which allow them to pursue educational possibilities.
